Terms of Neighborhood Support for Mixed Beverage Licenses for Restaurants with
Live Music, Cover Charges, Dancing, or Promoted Events:

Notwithstanding anything else contained in the agreement set forth below, the applicant
agrees to comply with all local, state, and federal laws including but not limited to
payment of taxes (including admissions tax), accurate reporting of food and beverage
sales ratios, and licensing requirements.

  1. No underage events

  2. For any events sponsored by a third party promoter, the Shockoe Bottom
    Neighborhood Association must be formally notified one week prior to the
    event. Events promoted by a third party will not be common occurrences.

  3. The neighborhood asks that the applicant officially commit to a security
    staffing plan based on the capacity and nature of the event. This staffing plan
    should include off-duty sheriff’s deputies or police officers. In addition to
    uniformed deputies or police officers, the plan may also include licensed
    security personnel. The sheriff’s deputies or police officers shall be assigned
    to the front door throughout the evening and that the other security personnel
    be responsible for patrolling the rest of the restaurant.

  4. If unrest inside the restaurant or unrest outside but attributable to patrons of
    the restaurant warrants an official police response with a police report, the
    applicant agrees to the following:

    a. 1st Police Report in a 12 month period – no consequences with regard to
    this agreement

    b. 2nd Police Report in a 12 month period – applicant agrees to a formal
    meeting with the Richmond Police Department’s Sector 112 Lieutenant, a
    designated enforcement agent from Virginia Alcoholic Beverage Control,
    the President of the Shockoe Bottom Neighborhood Association, and the
    Public Safety Chairman of the Shockoe Bottom Neighborhood.

    c. 3rd Police Report in a 12 month period – Applicant agrees to voluntarily
    surrender the mixed beverage license. Applicant may maintain a
    beer/wine license.

    d. 4th Police Report in a 12 month period – Applicant agrees to voluntarily
    surrender all ABC licenses.
